Terms and Conditions for Training Participants:

I. PARTICIPANT CONDUCT AND EXCLUSION
 

COMPANY RESERVES THE RIGHT TO EXCLUDE PARTICIPANTS FROM THE PROGRAM FOR INAPPROPRIATE BEHAVIOR, INCLUDING BUT NOT LIMITED TO HARASSMENT, THREATS, OR INTERFERING WITH OTHERS' ENJOYMENT. NO REFUNDS WILL BE GIVEN FOR UNUSED PORTIONS OF THE PROGRAM IF EJECTED OR IF PARTICIPANTS CHOOSE NOT TO PARTICIPATE IN CERTAIN ACTIVITIES.

 

II. PHOTO RELEASE
 

You agree to allow Company to use images or video of you in its marketing materials and other publication media without receiving any compensation.

 

III. COVID-19 HEALTH AND SAFETY PROTOCOLS
 

A.  In order to take part in any in-person Company program, you must comply with Company's and any relevant government body's COVID-19 health and safety guidelines.
 

B. You recognize the extremely contagious nature of COVID-19 and its variants, and understand that no measures can completely eliminate the risk of exposure while participating in the program. Despite this risk, you acknowledge that you are choosing to participate in the training voluntarily. 

 

IV. CONFIDENTIALITY AND NONCOMPETITION
 

A. You agree not to disclose or use any confidential information from Company's program without prior written consent. This information includes all content, materials, and methodologies developed by Company or its affiliates. You may only use this information for providing services to your clinical clients and may not use it to create similar programs or share it with others offering similar programs.
 

V. PHOTOGRAPHY, VIDEO, AND AUDIO RECORDING OF ANY OR ALL PART OF THE PROGRAM IS PROHIBITED. SHARING LINKS FOR VIRTUAL PROGRAMS IS PROHIBITED. 
 

If you have any recordings or images from the program, you agree not to share, upload, publish, or make them available to others under any circumstances.

 

 VI. LIMITATION OF LIABILITY AND DAMAGES

1. Company is not responsible for any consequential damages, including lost profits, regardless of the circumstances.
 
2. Company's liability for program-related claims is limited to the fees paid by the participant.

 

3. This clause remains valid even after the agreement ends, and any claims must be made within one year except for payment due to Company. 
 

VII. LIMITED WARRANTY

Company does not guarantee the program's outcomes and only assures its role as a training provider. All other warranties, whether express or implied, are explicitly disclaimed by Company.

 

VIII. CANCELLATION AND REFUNDS

Cancellation Policy for Scheduled Trainings:

Minimum Attendance Requirement: Empower TCT reserves the right to cancel any training 10 days prior to the first day of the scheduled training if it does not meet its minimum attendance requirement of 8 or more participants.

Force Majeure Events: Empower TCT reserves the right to cancel any program if a Force Majeure Event occurs.

Refunds: In the event Empower TCT cancels a program, participants will participants will receive a refund of their registration fee as a credit to their credit card minus any fees upto 6% charged by credit platform; however, Empower TCT is not responsible for reimbursement of participants’ incurred travel, food, and/or lodging expenses. Please make your travel plans accordingly, as Empower TCT will not reimburse any costs or expenses related to travel, lodging, or meals in the event Empower TCT cancels a program. If you will be incurring significant travel or lodging expenses, we recommend you purchase travel insurance from a reputable provider. For clarity and the avoidance of doubt, no refund of any kind will be provided to any participant who is ejected from the program for any reason.

 

Force Majeure:
Empower TCT assumes no responsibility for any personal injury, property damage, financial or other loss, accident, delay, inconvenience, or irregularity which may be occasioned by reason of any matter beyond its control, including, but not limited to, personal illness, a delay or cancellation of a flight or other mode of transportation, cancellation of your hotel reservation or expulsion from any venue used by Empower TCT, acts of God, acts or orders of government, epidemics, pandemics or other public heath emergencies, war, terrorist acts, riots, local or national disasters, weather events, unavailability of coaches, trainers, or other staff, strikes or other similar or dissimilar events or occurrences beyond Empower TCT’s control (“Force Majeure Events”) that causes you to miss all or any portion of the program.

IX. Participant Cancellation, Transfer, and Refund Policy
 

  • 20+ days prior to event’s initial start date:

    1. Full refund of registration fee, less a $50.00 USD administrative fee

    2. 1 free complimentary transfer

      • Once used, $100.00 USD transfer fee

 

  • 10-19 days prior to event’s initial start date:

    1. 25% refund of registration fee

    2. $125.00 USD transfer fee

 

  • 9 days or less prior to event’s initial start date / No-Show to event:

    1. No refund

    2. $150.00 USD transfer fee

    3. A “No-Show” is a participant who has registered for a training but who does not cancel their registration or attend the training.

  • Transfers are only eligible for 12 months (1 year) from the date of registration. After this date, participants will forfeit the full price of their registration fee and, if still interested in attending, need to re-register and pay the full registration fee again.

  • Refunds and transfer requests will be processed as they are received (our office is located in the Pacific time zone) and may take up to 5-7 business days to process.

  • Cancellation and transfer requests shall be submitted in writing to info@empowertctinc.com.

    X. ADA : Complaints and Grievances
     

  • Empower TCT Courses are held in facilities that are in accordance with the American Disabilities Act. Please contact Info@empowertctinc.com to request special accommodations for disability (ADA).

  • During a training event, the trainer responsible for conducting the training has Empower TCT’s authority to address any concerns that arise during the actual training. Every effort will be made to address the concerns during the training to include changing practice partners, addressing staff issues, etc.

  • If the trainer is unable to address the participant’s concerns, the complaints and grievances shall be presented in writing to Larisa Traga, LCSW, Founder, Empower TCT.

  • Empower TCT’s approach in resolving grievances is always from the perspective of what is in the best interest of the participant. All complaints and grievances are reviewed within 5 working days. Formal grievances are required to be written and emailed to Info@EmpowerTCTinc.com and will be responded to within 10 business days.

  • During registration, program participant acknowledges receipt of these terms and conditions and signifies acceptance of, and consents to, all of the terms and conditions set forth herein, on behalf of any participants they may act for, and for themselves, when registering for, or making payments on, this program.
